The incident occurred on December 15, 2022, at the Flying J truck stop. The victim, who was 17 weeks pregnant at the time, was walking towards the gas pumps when Moreno-Gutierrez’s Cadillac Escalade struck her, causing her to be thrown off her feet and onto the concrete. Security camera footage captured the incident, showing the Cadillac accelerating just before impact.

Although the victim sustained injuries, including pain in both hips and her back, along with other complications, her unborn child did not suffer any known injuries. Despite initially stopping, Moreno-Gutierrez left the scene shortly afterward. He later came to the police department and claimed that he accidentally struck the woman while looking for an open gas pump and left when he believed she was uninjured. However, a language barrier existed as Moreno-Gutierrez does not speak English.

In addition to this incident, Moreno-Gutierrez was also involved in a previous case involving an assault, where prosecutors sought to revoke his probation for burglary. However, the judge denied the motion but amended the probation rules.

In the previous case from April 2021, Moreno-Gutierrez was accused of assaulting a man by punching him and stomping on his ankle, possibly causing a fracture. He provided minimal explanation for his actions, stating that the victim had disrespected him.

The guilty plea and subsequent sentencing serve as a resolution to this case, emphasizing the importance of accountability for reckless behavior.
